PERM
An overview of the labor certification process

The three main requirements under PERM:
  • The wage offered must be equal to the ‘prevailing and actual wage’ for the occupation;
  • The minimum requirements for the position must be justifiable; and
  • The employer must undergo a recruitment process in order to demonstrate
     no qualified and available U.S. workers are available for the position;

Outstanding Researcher/Professor
An overview of the Outstanding Researcher/Professor category
  • Three years of teaching and/or research experience;
  • Internationally recognized in the field of expertise;
  • Have tenure track position or equivalent; or research position at private organization, subject to certain criteria;

National Interest
An overview of the National Interest category
  • Must seek employment in area of substantial intrinsic merit;
  • Benefit of your services must be national in scope;
  • The national interest would be adversely affected if labor certification is required;

Extraordinary Ability
An overview of the Extraordinary Ability category

Extraordinary ability means a level of expertise indicating that the individual is one of that small percent of those who has risen to the top of his or her field of endeavor. To be considered as an alien with extraordinary ability, the alien must have sustained national or international acclaim in the field of science, art, education, business or athletics.
